22- ENVIRONMENT


The Law Concerning the Ratification of The Agreement Between the Republic of Turkey and the European Community on the Accession of the Republic of Turkey to the European Environment Agency and the European Environment Information and Observatory Network, and the Final Act of the Negotiations for the Adoption of The Agreement Between the Republic of Turkey and the European Community on the Accession of the Republic of Turkey to the European Environment Agency and the European Environment Information and Observatory Network was published in the Official Gazette No:25007 dated 28 January 2003.
In the 2003 Accession Partnership Document, adopting a programme for transposition of the acquis and developing a plan for financing investment, based on estimation of the cost of alignment and realistic sources of public and private finance, are priorities under the environment heading. In this context the “Analysis of Environmental Legislation for Turkey” project (MEDA/TUR/ENLARG/D4-01) financed by MEDA Funds, was completed in 2002. Current environment legislation has been compared with EU legislation, a gap analysis and needs assessment study has been completed, and investment costs for directives requiring heavy investment have been calculated within the scope of this project. Exact investment needs will be determined once the Integrated Environmental Approximation Strategy for the Turkish Republic (No:2002-31739) Project is completed in 2004. In addition, studies on priority environmental projects for accession, and supporting the development of an efficient financial mechanism for financing EU environmental heavy-cost directives will be carried out under the environmental heavy cost investments component of the Capacity Development in The Field Of Environment Project (TR-362.03), within the framework of the 2002 Pre-accession Financial Assistance Programme.
Integrating sustainable development principles into the definition and implementation of all other sectoral polices is a medium term priority of the 2003 Accession Partnership Document. In this framework, a project fiche has been prepared and will be submitted to the Pre-accession Financial Assistance Programme at the most appropriate time.
The Draft Act on the Amendment of Environment Law, also contains provisions on access to environmental information. Within the “institution building and access to environmental information” component of the “Capacity Building in the Field of Environment for Turkey” (TR-362.03) project approved under the 2002 Pre-accession Financial Assistance Programme, studies to create a national database in environmental information and the training of staff for strengthening administrative capacity, will be realized.
Legislation on reporting in the context of EU environment legislation will commence only after harmonization and implementation of related legislation and infrastructure studies have been initiated.
Secondary Legislation promulgated after the publication of the first National Programme is listed in Annex 22.1.
Turkey’s position and procedures to be followed with respect to multilateral environmental agreements to which EC is party are given in Annex 22.2.

PRIORITY 22.1 Improvement of Water Quality
Improvement of water quality has been assigned as a priority, since, starting transposition and implementation of the acquis related to water quality is a short-term priority, and completing the transposition of the acquis and strengthening the institutional, administrative, and monitoring capacity, including data collection, to ensure environmental protection is a medium-term priority of the Accession Partnership document.
Task 22.1.1 Discharge of Dangerous Substances into Aquatic Environments
1-Priority Description
Discharge parameters in the Implementing Regulation on Water Pollution Control published in the Official Gazette No. 19919 dated 4 September 1988, have been collected under 16 sector headings, and sectoral discharge parameters have thus been determined. Discharge parameters in EU legislation have been established by taking into account “Best Available Technologies”. In this respect, in terms of both legislation and implementation, there is a need for harmonization. According to the Law on Fisheries and Agricultural Products No. 1380 and Implementing Regulation on Fisheries and Aquacultural Products, seas and inland surface waters are defined as supply areas of fisheries and aquacultural products. In seas and inland surface water sources, where fisheries and acquacultural products are concerned, environment and waste water discharge criteria defined in the Annex 5 and 6 of the Implementing Regulation on Fisheries and Aquacultural Products have to be aligned with EU legislation.

Task 22.1.2 Water Pollution Caused by Nitrates from Agricultural Sources
1-Priority Description
There is no corresponding Turkish legislation for Directive 91/676/EEC. Therefore, draft legislation is being prepared. In order to protect fisheries and acquacultural products from pollution originating from agricultural nitrate sources, environment friendly agricultural methods have to be introduced. A transition period is required for full implementation.

Task 22.1.3 Water Framework Directive
1-Priority Description
There is no corresponding Turkish legislation for Directive 2000/60/EC under the EU water management heading. Implementation of subjects covered by the aforementioned directive is under the authority and responsibility of various administrative institutions, therefore, a MATRA project, “Implementation of the Water Framework Directive in Turkey” has been designed and initiated. The project will identify how the current administrative structure needs to be transformed, in order to implement Directive 2000/60/EC. Following the completion of the MATRA project, another project comprising training of central and provincial units on the alignment and implementation of Directive 2000/60/EC, strengthening of administrative structures, and investment needs for implementation purposes, will be proposed to the Pre-accession Financial Assistance Programme.

Task 22.1.4 Treatment Plant Sludge
1- Priority Description
The Implementing Regulation on Soil Pollution Control published in the Official Gazette No. 24609 dated 10 December 2001 is largely compatible with corresponding EU legislation. However, there are difficulties with respect to implementation. Alignment with EU legislation on treatment plant sludge is under the responsibility of the Ministry of Environment and Forestry, and the Refik Saydam Hygiene Centre of the Ministry of Health carries out analyses on treatment plant sludge, subject to the Implementing Regulation for Soil Pollution Control. Studies with respect to treatment plant sludge in Turkey are carried out by only a few local administrations, including the Ankara Metropolitan Municipality. One of the most important problems associated with this issue is the elimination of treatment plant sludge. A limited number of analysis have been carried out, the results of which display typical domestic waste properties.

Task 22.1.5 Urban Wastewater Treatment
1-Priority Description
The Turkish legislation corresponding to Council Directive 91/271/EEC is the Implementing Regulation on Water Pollution Control. However, in practice, the construction of waste treatment plants for the benefit of municipalities is the responsibility of the Bank of Provinces and metropolitan municipalities, and in rural areas this responsibility belongs to the General Directorate of Rural Services. Discharge parameters for urban wastewater are not fully compatible with EU legislation and alignment of legislation as well as additional investment to existing waste treatment plants is necessary. A transition period is necessary for full implementation, since this directive is one of the heavy cost investment directives.

Task 22.1.6 Quality of Water Intended for Human Consumption
1-Priority Description
The Implementing Regulation on Water Pollution Control and the Implementing Regulation on Production, Packaging, Sale and Inspection of Water for Human Consumption, published in the Official Gazette No. 24759 dated 25 July 2001, are Turkish legislation corresponding to EU directives related to water management and listed under this priority. Studies are underway for a draft Implementing Regulation on Bottled Waters and Water for Human Consumption and Use, which will repeal the Implementing Regulation on Production, Packaging, Sale and Inspection of Water for Human Consumption. Directives on quality of water for human consumption fall under the responsibility of various different organizations and institutions. Turkish legislation corresponding to EU Directives is partially aligned. A project has been prepared to be submitted to the 2004 Pre-accession Financial Assistance Programme for the purpose of harmonizing with Directive 98/83/EC on quality of water intended for human consumption.

Task 22.1.7 Quality of Surface Water and Ground Water
1-Priority Description
Turkish legislation corresponding to EU directives cited under this priority and related to water management are the Implementing Regulation on Water Pollution Control, Implementing Regulation on Fisheries and Aquacultural Products and the Law on Ground Water published in the Official Gazette No.10688 dated 23 December 1960.
In order to protect public health, the Ministry of Health monitors sea water quality in provinces having a coastline. The assessment of analyses done in this context is made in accordance with limit values envisaged by the Implementing Regulation on Water Pollution Control published by Ministry of Environment and Forestry. Provisions and parameters given in the Implementing Regulation on Water Pollution Control are not fully aligned with Directive 76/160/EEC. A project aiming at harmonization with Council Directive 76/160/EEC concerning the quality of bathing water, has been prepared for submission to the 2004 Financial Cooperation Programme.

PRIORITY 22.2 Increase Effectiveness of Waste Management
In order to begin to transpose and implement acquis related to waste management, a short term priority in the Accession Partnership Document, and to complete the transposition of the acquis and strengthen the institutional, administrative, and monitoring capacity to ensure environmental protection including data collection, a medium term priority, increasing the effectiveness of waste management is designated as a priority.
Although existing Turkish legislation is to a large extent harmonized with relevant EU legislation, studies have been initiated to prepare draft regulations and proposals for amendments in order to fully complete alignment with the EU directives listed below. Turkey’s major problems related to waste management are the elimination of hazardous waste from industry, and the combination of industrial and domestic waste, domestic waste, specific waste, and construction waste all together, without separate collection. However, in the framework of regulations prepared by the Ministry of Environment and Forestry, the metropoles in particular have initiated integrated solid waste management studies, and collection and elimination of waste following categorization is being realized to a certain extent. In Turkey, there are plants for the elimination of hazardous and domestic waste, albeit few in number.
A project proposal (TR-302.03) has been submitted to the 2003 Pre-accession Financial Assistance Programme to create the necessary capacity in the Ministry of Environment and Forestry for the implementation of legislation and harmonization of Turkish legislation with European Parliament and Council Directive 94/62/EC on packaging and packaging waste, Council Directive 75/442/EEC on waste, Council Directive of 12 December 1991 on hazardous waste, Directive 2000/76/EC of the European Parliament and of the Council of 4 December 2000 on the incineration of waste, Council Directive 1999/31/EC on the landfill of waste, and Council Regulation 259/93/EEC on the supervision and control of shipments of waste within, into and out of the European Community.
Task 22.2.1 Integrated Waste Management
1-Priority Description
Various legislation contain points corresponding to directives listed in the table, however this situation leads to repetitions. Therefore, taking into account the results of the “Analysis of Environmental Legislation for Turkey” (MEDA/TUR/ENLARG/D4-01) separate regulations will be prepared corresponding to the directives in question in order to simplify the implementation.

Task 22.2.2 Hazardous Waste Management
1-Priority Description
Implementing Regulation on Hazardous Waste Control published in the Official Gazette No. 22387 dated 27 August 1995 corresponds to a large extent to definitions and provisions of Council Directive 75/442/EEC on waste. However, provisions relating to waste management principles are not clear and there is a need to strengthen provisions regarding record keeping, monitoring and enforcing. Studies to change relevant Turkish legislation has been initiated, and in the light of the results of the Project on Hazardous Waste Management financed out of the national budget, harmonization strategies are being prepared.
Turkey has been a party to the Basel Convention since 1994. Provisions of the convention are strictly implemented within the scope of the Implementing Regulation on Hazardous Waste Control. In the accession process, preparation of separate implementing regulation concerning the shipment of waste is envisaged.

Task 22.2.3 Specific Waste Management
1-Priority Description
The Implementing Regulation on Solid Waste Control contains certain provisions regarding management of packaging waste management. Waste oils, disposal of PCB (polychlorinated biphenyls) and PCT (polychlorinated terphenyls), spent batteries and accumulators are within the scope of the Implementing Regulation on Hazardous Waste Control. However, there is no corresponding Turkish legislation reflecting the provisions of the Directive on end-of-life vehicles. Even though, parts of the existing Turkish legislation are in harmony with certain provisions of directives on waste management, there are legal gaps and specific issues that need to be clearly identified. In this context, studies have been initiated to prepare draft regulations in full harmony with the EU directives listed below.

PRIORITY 22.3 Improving Air Quality
1-Priority Description
Air quality has been designated as a priority, considering that beginning to transpose and implement the acquis is a short term priority, and completing the transposition of the acquis and strengthening institutional, administrative, and monitoring capacity, including data collection, to ensure environmental protection are medium term priorities in the 2003 Accession Partnership Document.
There is a need for eliminating differences between Turkish and EU air quality legislation. The Ministry of Health contributes to harmonization efforts carried out by the Ministry of Environment and Forestry.
The project entitled “strengthening of the implementation of Council Decision 97/101/EC on ambient air quality assessment, management and reciprocal information exchange (as part of Air Quality Directive 96/62/EC) at the Refik Saydam Hygiene Centre, Ministry of Health, Turkey”, supported by bilateral cooperation with the Government of the Netherlands MATRA Programme, was initiated in 2003. In addition, in the scope of the Support to Turkey in the Field of Air Quality, Chemicals and Waste Management Project, which was submitted to 2003 Financial Cooperation Programme, strengthening of administrative capacity for harmonizing and implementing Air Quality Directive 96/62/EC will be studied.

PRIORITY 22.4. Nature Protection
1- Priority Description
In the Council Decision of 19 May 2003 on the Accession Partnership with the Republic of Turkey, the adoption and implementation of the acquis on nature protection is among the short-term priorities.
The Implementing Regulation Regarding the Convention on International Trade in Endangered Species of Wild Fauna and Flora was published in the Official Gazette No. 24623, dated 27 December 2001 and entered into force on the same date. The Communiqué No 2003/19 on the Import of Endangered Species of Wild Fauna and Flora and Communiqué No 2003/1 on the Export of Endangered Species of Wild Fauna and Flora were published in the Official Gazette No. 25027, dated 21 February 2003. In the preparation of the above-mentioned Implementing Regulation, Directive 338/97/EC was taken into consideration. However, only partial compatibility has been achieved and studies continue in order to achieve full compatibility.
The following legislation is covered within the context of the Twinning Project on Capacity Building In the Field of Environment for Turkey in the 2002 Pre-accession Financial Assistance Programme:
- Council Directive 79/409/EEC of 2 April 1979 on the conservation of wild birds as amended by Directive 97/49/EEC
- Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora as amended by Directive 97/62/EC
- Council Regulation (EC) No 338/97 of 9 December 1996 on the protection of species of wild fauna and flora by regulating trade therein
- Commission Regulation (EC) No 1808/2001 of 30 August 2001 laying down detailed rules concerning the implementation of Council Regulation (EC) No 338/97 on the protection of species of wild fauna and flora by regulating trade therein
Although revisions to the Law on Environment, the Law on National Parks and the Law on Land Hunting continue in order to eliminate gaps and weaknesses in the current legislation, a new law in order to adopt the Habitat and Birds Directives, to protect biodiversity, and with regard to nature protection is also assumed to be necessary. This new law will also provide a framework for the adoption and implementation of the nature protection component of the EU environment acquis.
A strategy has been prepared to protect biodiversity with a project financed by Global Environmental Facility (GEF) Funds and to draft a new law for nature protection.

PRIORITY 22.5 Industrial Pollution and Risk Management
1-Priority Description
Industrial pollution and risk management are assigned as priorities, considering that beginning to transpose and implement the acquis is a short term priority, and completing the transposition of the acquis is a medium term priority in the 2003 Accession Partnership Document.
The project entitled “Institutional strengthening for the adoption and implementation of integrated pollution prevention and control directive (IPPC - 96/61/EC)”, supported by the bilateral cooperation with the Government of Netherlands, MATRA Programme, was initiated in 2003. In addition, the Support to Turkey in the Field of Air Quality, Chemicals and Waste Management Project (TR-362.03), which has been submitted to the 2003 Pre-accession Financial Assistance Programme, involves strengthening of administrative capacity for harmonizing and implementing Directive 2001/80/EC of the European Parliament and of the Council of 23 October 2001 on the limitation of emissions of certain pollutants into the air from large combustion plants.
The Seveso I Directive was translated into Turkish in 1996 and The Circular on Local Emergency Plans for Major Industrial Accidents was prepared and has been communicated to all provinces. In the frame of the Seveso II Directive (96/82/EC), the Draft Implementing Regulation on Functions of Environment Emergency Centres and Principles of Emergency Intervention is being prepared. Since implementation of the Seveso II Directive requires heavy cost investment for both public and private sector, the Seveso II Directive could not be elaborated in this National Programme.
For the harmonization and implementation of Directives on industrial pollution and risk management, particularly integrated pollution prevention control and the limitation of emissions of certain pollutants into the air from large combustion plants, heavy cost investments and strengthening of technical capacity are required.
For the implementation of legislation under this priority, transition periods will be required depending on whether the investment needs are met.

Aligning with the strategic environmental assessment Directive is designated as a priority, considering that beginning to transpose and implement the acquis is a short term priority, and completing the transposition of the acquis is a medium term priority in the 2003 Accession Partnership Document.
The project entitled Adoption and Implementation of the Strategic Environmental Assessment (SEA) Directive (2001/42/EC) in Turkey, supported by bilateral cooperation with the Government of the Netherlands, MATRA Programme, was initiated in 2002 and will be completed at the end of the year 2004. It also includes a pilot project to test the implementation of the Draft SEA Regulation on the tourism sector.

1-Priority Description
Environmental noise management is designated as a priority, considering that beginning to transpose and implement the acquis is a short term priority, and completing the transposition of the acquis is a medium term priority in the 2003 Accession Partnership Document.
In order to align Turkish legislation with EU noise legislation, noise maps and action plans, which are taken up in Directive 2002/49/EC of the European Parliament and of the Council of 25 June 2002 relating to the assessment and management of environmental noise, should be developed. Adoption of action plans including preventative measures, based on the results of noise mapping requires considerable infrastructural investment and strengthening of institutional capacity. Within the scope of noise pollution in Turkey, the Implementing Regulation on Noise Control, which was issued in the Official Gazette numbered 19308 dated 11 December 1986, is in force. Implementation of the regulation is carried out by local authorities. Current legislation needs to be reviewed for full harmonization of related EU legislation.

PRIORITY 22.9 Genetically Modified Organisms
1-Priority Description
Genetically modified organisms are designated as a priority, considering that beginning to transpose and implement the acquis is a short term priority, and completing the transposition of the acquis is a medium term priority in the 2003 Accession Partnership Document.
Legislation preparation studies on genetically modified plants was started at the beginning of 1998 by Ministry of Agriculture and Rural Affairs. The Directive concerning genetically modified organisms-transgenic cultural plant field survey prepared at the end of these studies was enforced by Ministerial Permission dated 14 May 1998 and numbered TGD/TOH-032. This Directive includes procedures applied on both genetically modified organisms developed abroad and desired to be imported, and genetically modified organisms developed in Turkey.
In this context, together with the Bio-safety Research and Development Project financed by the national budget and started in 2001, the development of the National Biosafety Framework Project, financed by GEF and being implemented in the period between September 2002-February 2004, aimed to identify the needs of legal, administrative and technical structures for the implementation of the Cartagena Protocol on Biosafety of the United Nations Biological Diversity Convention, are being carried out by the Ministry of Agriculture, Rural Affairs General Directorate of Agricultural Research.
