II- MEASURES FOR HARMONIZATION WITH THE EU LEGISLATION AND IMPLEMENTATION
PRIORITY 25.1 Customs Law and Its Implementing Provisions
1- Priority Description
In accordance with the customs union, which entered into force on 1 January 1996, the Customs Law and its implementing provisions are to a large extent in conformity with the EU legislation. Further, in an attempt to reflect the changes in EU customs legislation within Turkish customs legislation, Customs Law No 4458 and the Implementing Regulation on Customs are being amended.
Turkey is a party to the Kyoto Convention and its Annexes (A1, A2, A3, B1, E3, F5). Since primary consideration is given to being a party to the Revised Kyoto Convention rather than the Kyoto Convention, the Revised Kyoto Convention is taken as the basis for harmonisation efforts. Turkey has initiated the ratification procedure to join the Revised Kyoto Convention.
The Guidelines on Customs Declarations and the relevant forms prepared for the implementation of the Single Administrative Document, which is in conformity with the Implementing Provisions of the Community Customs Code, is attached as Annex No.20 of the Implementing Regulation on Customs published in the Official Gazette No 24771 of 31 May 2002. For the Common Transit, translation is complete and the Implementing Regulation on Common Transit has been prepared. However, being a party to the Common Transit and Single Administrative Document requires the approval of the countries that are party to these Conventions.
Although Customs Law No 4458 is to a large extent parallel to the EU Customs Code provisions concerning free zones, at the present time implementations in the free zones are governed by the Free Zones Law No 3218, which has a special character.
In the field of free zones, efforts for the elimination of differences between the practices of the EU and Turkey continue. Accordingly, the role of free zones in the economic development of Turkey and the acquired rights of the existing companies are taken into consideration. In order to incorporate goods not in free circulation in the production activities of the free zones, without being restricted by “Inward Processing and Processing Under Customs Control Regimes”, it is intended that until Turkey becomes a member of the EU the Turkish Free Zones will be covered by the exemptions provided in Article 173 of EU Customs Code for Hamburg, the Canary Islands, the Azores, and Madeira Free Zones.
For the remaining issues regarding free zones, alignment with the EU Customs Code will be accomplished when Turkey becomes a member of the EU, at the latest. The exact timetable concerning alignment will be prepared and submitted to the EU during the negotiation process.

PRIORITY 25.2 Harmonization of the rules of origin
1- Priority Description
The rules of origin published in accordance with the arrangements in the Import Regime Decree for the purpose of alignment with the Generalized System of Preferences (GSP), are in conformity with the rules stipulated in the EU Customs Regulation.
Origin Protocols annexed to the Free Trade Agreements are in line with EU Origin Protocols. Since Turkey is a party to the Pan-European Origin Cumulation System, amendments in this system are followed regularly and the origin rules are the same as the other countries in the system.
Formulating origin protocols is dependant on signing an agreement with the related countries. Since the conclusion and entry into force of an agreement does not solely depend on the will of Turkey, it has not been possible to set an alignment schedule. EU Origin Protocols will continue to form the basis for the Origin Protocols of the forthcoming Free Trade Agreements.
Similarly, in the case of signing agreements parallel to the agreements that the EU concluded with certain third countries concerning textiles, EU protocols will form the basis of the protocols for the rules of origin.

a) Some provisions of the related EU legislation are directly related to the Member States. Therefore, the Implementing Regulation will provide partial alignment. Full alignment will be achieved upon accession.

Turkey is largely in conformity (i.e. codes and definitions of goods, duty rates of goods covered by the customs union, measurement units, chapter and section notes and annex notes) with the Combined Nomenclature provided in Annex 1 of Council Regulation 2658/87. The first alignment was implemented with the Council of Ministers Decree No 95/7591 amending the Customs Tariff List. In accordance with the revisions in the Combined Nomenclature of the EU, Turkish Customs Tariff Lists are published as a Council of Ministers Decree every December (The latest Council of Ministers Decree was published in the Official Gazette No 24078 of 29 December 2002).
Partial harmonization has been made with the trade measures listed in Annex 2 of the above mentioned Regulation.
Due to its structure, full alignment with the Regulation and also with the TARIC will be attained by the time of membership.
In addition, transposition of the Classification Decisions and Explanatory Notes of the Combined Nomenclature will be accomplished in 2005.

PRIORITY 25.4 Strengthening the administrative and operational capacity of the customs administration to fight against smuggling
1- Priority Description
Priorities are given to the issues of alignment with EU customs legislation, administrative cooperation, and the fight against fraud. Accordingly, cooperation with the EU in customs matters proceeds at the maximum level.
With respect to the issue of strengthening the administrative capacity of the customs administration, studies proceed within the scope of the “Customs Blueprint”(Detailed information on this issue is given in Table 25.4.2). Although they may not be directly related with the harmonization of legislation, the measures for strengthening the administrative capacity of the customs administration and the capacity to fight againsts smuggling are provided under this priority.
In addition, a Law Information System has been established for electronic storage of the records of lawsuits pursued in central and provincial organizations, and for providing the centralized control of lawsuits. The initial implemention of this system took place within the Istanbul Directorate of Customs on 10 June 2002. In the meantime the system has been established in some central units and regional directorates. It is planned to extend the system in the forthcoming period.
Alignment with the EU legislation is accomplished to a large extent as regards pirated and counterfeit goods. Additionaly, with amendment to the Customs Law and its Implementing Regulation harmonization will be completed. This issue has also been included in the training program for customs personnel.
Turkey signed mutual administrative cooperation agreements in customs matters with Georgia, U.S.A, Cuba, Ukraine, Israel, Macedonia, the UK, Russia, Krgizistan, Uzbekistan, Romania, Bulgaria, Turkmenistan, Albania, Estonia, Tajikistan, Croatia, Egypt, Mongolia, Poland, Greece, the Czech Republic, Lithuania, the Republic of Slovakia, Spain, Iran, Italy, Algeria, Serbia and Montenegro, People’s Republic of China, Pakistan and Bosnia-Herzegovina (32 countries in total). Accordingly, Turkey has concluded agreements and protocols with 7 out of 15 countries with which the EU has signed Mutual Administrative Cooperation Agreements.
Technical hardware, software, recruitment and training programs are foreseen for anti-smuggling pruposes. “Law No. 1918 on the Interdiction and Pursuit of Trafficking” will be amended.

PRIORITY 25.5 Interconnectivity Between Electronic Systems
1- Priority Description
Use of Information Technologies for Customs Purposes
Participation of the Undersecretariat for Customs and of other institutions - if deemed necessary – in the Customs Information System (CIS), which provides information exchange between customs administrations of the European Union, is only possible after accession to the EU. The necessary infrastructure in this field exists within the Undersecretariat for Customs.
Common Communication Network/ Common System Interface, New Computerized Transit System, TARIC (CCN/CSI, NCTS, TARIC)
Although one-to-one correspondence has not been observed between the legislation in order to perform studies regarding interconnectivity of electronic systems with those of the Community (loading of CCN/CSI, necessary developments for NCTS, Integrated Tariff Management System), the objective is to complete the efforts for alignment of computer systems by December 2005.

Alignment of legislation in this area will be accomplished gradually until the time of membership. The implementation of the legislation requires institutional building and financing. Accordingly, the schedule of necessary institutional changes and the financing requirements are provided in Tables 25.5.1. and 25.5.2., respectively.

II- MEASURES FOR HARMONIZATION WITH THE EU LEGISLATION AND IMPLEMENTATION

PRIORITY 26.1. Generalized System of Preferences
1- Short Description
With a view to aligning with the Generalized System of Preferences (GSP), the first arrangement entered into force as of 1 January 2002 in the context of the Import Regime Decree of 2002, and the arrangements required for the rules of origin were implemented with Council of Ministers Decree No 2001/3485. In this regard, apart from the implementation under “the special arrangements to combat drugs production and trafficking” and special incentives, all Community arrangements were incorporated into the aforementioned Regime for 2456 raw materials and semi-finished goods in 12 digit CN Codes. Accordingly, “Everything But Arms (EBA)” initiative has also been made operational for these 2456 goods, in favor of the least developed countries (LDC). Thus, it has become possible for the countries included in the Community’s GSP regime to benefit from the system.
With the Decree Annexed to the Import Regime Decree of 2003 that entered into force as of January 2003, the number of goods benefiting from the GSP increased to 2884, with the inclusion of 428 products in 12 digit CN Codes.
With the existing arrangement, the outcomes of the EU’s regime were achieved in terms of country coverage, sensitivity of products and preferential duties; except for the tariff reductions applied under special incentive mechanisms. There are still differences between the product coverage of the EU’s Generalized System of Preferences and Turkey’s arrangements.
Efforts for alignment with the EU’s Generalized System of Preferences will be maintained by taking into consideration Turkey’s needs. To this end, talks with the European Commission concerning complete alignment with the Community system will continue.


PRIORITY 26.2 Free Trade Agreements (FTA)
1- Short Description
In line with efforts for the adoption of the EU’s preferential trade agreements, Turkey has concluded free trade agreements with all Central and Eastern European countries, Israel, Macedonia, Bosnia-Herzegovina and Croatia. Apart from the agreements signed with Croatia and Bosnia-Herzegovina, all free trade agreements concluded by Turkey are in force. The Free Trade Agreement signed with Croatia will enter into force on 1 July 2003, whereas the Free Trade Agreement signed with Bosnia-Herzegovina is expected to enter into force in the third quarter of the year 2003. Moreover, the free trade agreement between Turkey and EFTA has been in force since the year 1992.
However, in the process of adopting the EU’s free trade agreements Turkey faces difficulties stemming both from the dynamic character of the EU’s external trade policy, and the unwillingness of countries with whom Turkey would like to sign free trade agreements. Since the EU becomes a party to new arrangements its preferential trade network continuously expands. Moreover, there have been serious difficulties in convincing third countries - Mediterranean countries especially - to initiate negotiations for free trade agreements, and to conclude agreements for which negotiations have begun. As a result, adoption of the EU’s preferential trade agreements remains a moving target for Turkey.
Since it is necessary that not only Turkey but the relevant third country should also show willingness, it has not been possible to set an alignment schedule for the process of adoption of the EU’s free trade agreements while third countries do not have such enthusiasm. Nevertheless, Turkey’s intense efforts in this field will continue in the forthcoming period. For the progress achieved in the adoption of the EU’s preferential trade agreements see Annex- 26.1.

PRIORITY 26.3 Dual-use Goods
1- Short Description
Concerning dual-use goods and technologies, the only difference between the systems of the EU and Turkey is that the control regime of the Community is carried out by one institution and through one piece of legislation; whereas in Turkey the system is administered by various institutions and by means of separate regulations. Turkey has been a party to all international export control arrangements and regimes aimed at controlling the export of dual-use goods to which the EU is a party. These arrangements and regimes are namely: the Wassenaar Arrangement; the Control Regime on Missile Technology; the Australia Group; the Nuclear Suppliers Group; the Zangger Committee; and the Convention on Chemical Weapons. Turkey controls all the equipment and technologies subject to Decision No 94/942/CFSP, cited in Article 5 of Council Regulation No 1334/2000, and modifies the list of controlled equipment and technologies in parallel with the changes in international arrangements. Although the criteria used in controls are those mentioned in Article 7 of the Regulation, the only underlying difference is that while EU bases its controls on one piece of legislation, the control of items subject to the export control regime in Turkey falls within the competence of more than one institution and within the framework of more than one legislative arrangement, due to the specific characteristics of these items.
