Laws, which have been enacted for the harmonization process with the EU Acquis since the publication of the first National Program on 24 March 2001, are provided below; while legislation other than laws are listed in Annex 7.1 along with the EU legislation to which they correspond:
- Law No. 4631 on Animal Breeding published in the Official Gazette No. 24338 on 10 March 2001 and entered into force on the same date, set the legal basis for alignment to the EU legislation on zootechnics.
- Law No. 4634 on Sugar published in the Official Gazette No. 24378 on 19 April 2001 and entered into force on the same date, introduced contractual system in sugar beet production and quota system in sugar production.
- Law No. 4648 Amending the Law on Animal Health and Surveillance published in the Official Gazette No. 24384 on 26 April 2001 and entered into force on the same date, introduced arrangements concerning regionalization of countries for which import restrictions are imposed due to certain animal diseases.
- Law No. 4733 on Restructuring of the Directorate General of Tobacco, Tobacco Products, Salt and Alcohol Enterprises and on Manufacturing, Domestic and Foreign Purchase and Sale of Tobacco and Tobacco Products; and Amending Law No. 4046 and Decree Law No. 233, which was published in the Official Gazette No. 24635 on 9 January 2002 and entered into force on the same date; set the legal basis for the sales of tobacco through auctions and production through contracts.

II- MEASURES FOR HARMONISATION WITH THE EU LEGISLATION AND IMPLEMENTATION

PRIORITY 7.1 Alignment to the Arrangements on Horizontal Issues

1- Priority Description
The tasks listed under this priority cover the issues particularly emphasised in the 2001 and 2002 Progress Reports of the European Commission.

Task 7.1.1 Setting up the Main Components of the Integrated Administration and Control System (IACS)
In the 2003 Accession Partnership, “to complete the establishment of animal identification systems, which are a key element of the Integrated Administration and Control System” and “to begin preparatory work on other elements such as the land parcel identification systems” are set as short-term priorities, while “to complete the establishment of the Integrated Administration and Control System” is listed as a medium-term priority.
There is no corresponding Turkish legislation for IACS. However, in the scope of the Project on ‘Farmer Registry and Direct Payment’, direct income support has been initiated through various decrees and communiqués. Certain arrangements, such as, registration of the applicant farmers, farmer applications and cross compliance of the applications, bear some similarities with the basic elements of IACS. Despite these similarities, the current system in Turkey has certain points diverging from the EU’s IACS practices such as, in Turkey direct payments are allocated to all farmers provided that the field is cultivated, an annual flat-rate payment per hectare is paid regardless of the product, and there exists no control whether the declared product is cultivated in reality in the field for which the application is done.
In the field of identification and registration of animals, which is one of the main components of IACS, a database has been set up and identification and registration of animals have been initiated, within the scope of the ‘Implementing Regulation on the Identification, Registration and Monitoring of Bovine Animals’ that was published on 4 June 2000. This legislation was revised in 2002 for further harmonisation with EU rules. From the beginning of the implementation in June 2001 to June 2003 approximately 8 million bovine animals have been ear-tagged, of which 6,8 million cattle and approximately 1,2 million bovine animal holdings have been recorded in the computerized database.
Legislative harmonisation on the identification and registration of ovine animals has not been initiated yet as the relevant EU legislation is being revised and these adjustments would result in significant changes to infrastructure investments and implementation.
Under this priority, Council Regulation No 3508/92/EEC and Commission Regulation No 2419/01/EC will be harmonized regarding the establishment of the Integrated Administration and Control System. In this context, the obstacles in front of the establishment and implementation of the system stemming from the current legislation will be eliminated through certain legal amendments. Thus, in the short term it is envisaged to begin the preparatory work for the establishment of the required components of the system, and in the medium term to complete a functioning system.
With regard to institutional building, in order to transform the direct support system and other support systems into systems similar to those of the EU, it is planned to establish a land parcel identification system, particularly for agricultural land parcels; to use not only the administrative cross compliance but also field controls for the control of applications to area based supports by connecting the data of Farmers Registration System to those of the land parcel identification system; and to incorporate the data laid down in the database of the bovine animal identification system into the database established under IACS. Following the changes in the EU legislation on the identification and registration of ovine animals, work on legislative harmonization will be completed and a database integrated to IACS will be established.
Task 7.1.2 Establishment of Farm Accountancy Data Network (FADN)
There are some similarities between the agricultural structure inspection method used in some regions and enterprises in Turkey since 1998 and the practices of the Farm Accountancy Data Network (FADN) legislation. With regard to FADN, survey study of year 2001 is carried out in 78 provinces. The survey study will be carried out again in 2003 on the basis of variables determined according to the FADN variables.
The studies have shown that the infrastructure required for the implementation of the system exists, but nation-wide implementation requires significant amount of financial resources.
FADN is handled in the 2003 Accession Partnership Document under the medium-term priority of “adopt(ing) the legal basis, administrative structures and implementation mechanisms for the establishment of common market organisations and effective monitoring of agricultural markets”. Since FADN is a system which can be used efficiently in developing Turkey’s agricultural policies by obtaining detailed data on economic size and type from agricultural enterprises, harmonisation of the legislation and establisment of institutional capacity is set as an objective.
Task 7.1.3 Development of Administrative Structures Required for the European Agricultural Guidance and Guarantee Fund (EAGGF)
In the 2003 Accession Partnership Document “adopt(ing) the legal basis, administrative structures and implementation mechanisms for the establishment of common market organizations and effective monitoring of agricultural markets” is identified as a medium-term priority.
Payments towards market mechanisms (direct income support, storage aids, export refunds, etc.) developed under common market organizations are financed from the Guarantee section of the European Agricultural Guidance and Guarantee Fund. Whereas, the Guidance section mainly finances the rural development measures.
Full harmonisation with the EAGGF legislation will be possible upon accession. However, it is necessary to identify the administrative structures and implementation mechanisms prior to accession. In this context, it is envisaged to establish a Paying Agency, which will be in charge of the payments and arrangements of EAGGF related issues, and to improve the implementation capacity of the agency.
The structuring in other candidate countries regarding EAGGF have been developed through the establishment of a SAPARD Agency responsible for the management of the funds granted under the Special Accession Programme for Agriculture and Rural Development (SAPARD). These institutions are planned to be transformed into Paying Agencies upon accession.
Turkey has not been entitled to benefit from SAPARD, yet. However, in assessing the institutional building needs for EAGGF, it is foreseen to initiate the studies for the development of mechanisms required for SAPARD, taking into account the possibility that a decision will be taken on Turkey’s inclusion to SAPARD or a similar programme. Hence, the paying agency will be established in such a way to function as the SAPARD agency upon inclusion of Turkey in SAPARD.
Task 7.1.4 Organic Farming
In Turkey, organic farming practices were started in 1986 for export purposes. At the beginning, production and exportation of organic products were carried out according to the legislation of importing countries. Upon the entry into force of Council Regulation No 2092/91 in 1991, production and exportation of organic products to Member States has begun to be conducted on the basis of this Regulation. Since Annex No 94/92 to the Council Regulation No 2092/91 of 14 January 1992 obliged countries exporting ecological products to the Community to adopt their own organic farming legislation, with the cooperation of related institutions the Turkish Ministry of Agriculture and Rural Affairs prepared a legislation regulating organic farming activities in Turkey and the ‘Implementing Regulation on the Production of Animal and Plant Products with Ecological Methods’ entered into force upon its publication in the Offical Gazette No. 22145 on 24 December 1994.
This Implementing Regulation has been updated with a view to incorporating the amendments made to the Community legislation after 1991 and the new ‘Implementing Regulation on the Principles and Implementation of Organic Farming’ entered into force on 11 July 2002.
Although harmonization with EU organic farming practices has been ensured by this Regulation, lack of a framework Law on organic farming practices constitutes the main deficiency in this field. Therefore, the first priority is the adoption of the ‘Law on the Production, Consumption and Inspection of Organic Products and Inputs’. It is envisaged to enforce the draft Law by the end of this year. Following the adoption of this Law, necessary amendments will be made in the ‘Implementing Regulation on the Principles and Implementation of Organic Farming’ or additional regulations will be enacted taking into account the recent amendments made to the corresponding EU legislation.
With regard to the work on institutional infrastructure, Organic Farming Units will be established at the Provincial Agricultural Directorates. These units will be provided with necessary equipment and a communication infrastructure will be established. The personnel will be trained on implementing the legislation. These units will carry out the inspections of farmers and establishments.
A software programme functioning on the internet has been developed for the purpose of establishing information flow between the Ministry and Control and Certification Bodies, and monitoring and controlling the implementation of the legislation. An additional software programme will be developed to provşde flow of information on organic animal breeding and processing, importation, exportation, and control of organic products. Moreover, a network and database will be established to ensure information exchange among organic farming units and to monitor inspection results.

PRIORITY 7.2 Alignment to the Veterinary Acquis

1- Priority Description
According to the 2003 Accession Partnership Document, Turkey is expected to “adopt a veterinary framework law and acquis-harmonized secondary legislation; strengthen the human, technical and information resources of the relevant administrative, scientific, testing and inspection agencies; ensure enforcement of legislation; step up animal disease eradication efforts, contingency planning and monitoring capacity,” and to “identify sites for the development and operation of an EC-compatible system of Border Inspection Posts with third countries” in the short-term, while for the medium-term it is expected to “submit a plan and timetable for upgrading the system of Border Inspection Posts with third countries in line with the acquis”.
The harmonization process in the veterinary field is based on the Veterinary Project carried out under the 2002 Financial Cooperation Program. In the Veterinary Project, veterinary legislation, animal health, disease surveillance, control and eradication, veterinary information systems, veterinary border inspection posts, veterinary public health and animal welfare were identified as priority areas. Meanwhile, the Veterinary Framework Law, which is a prerequisite of the Twinning project, is being prepared through the technical assistance provided by the Administrative Cooperation Program. The Veterinary Framework Law will establish the legal basis, for the transposition of main EU regulations, directives and decisions into the Turkish legal system.
In the field of animal health, technical facilities of the Ministry of Agriculture and Rural Affairs will be improved to carry out the monitoring of the OIE list A and B diseases. In addition, national control and eradication programs will be prepared, and the facilities and diagnosis infrastructure of the veterinary laboratories will be improved. For the Blue tongue disease an action plan will be prepared, which will set the basis for the other diseases in the list A of the OIE.
A Veterinary Information System supporting the system on identification and registration of bovine animals, control of animal movements and disease control programmes and containing notification systems such as ANIMO, ADNS and SHIFT will be established. As a result, a network will be set up that will enable information exchange between the central and local organizations of MARA and border inspection posts, laboratories, slaughterhouses and major markets.
Regarding border inspection posts, institutional capacity on EU rules and practices will be improved and detailed plans will be prepared to upgrade 7 border inspection posts to meet EU standards. According to the Veterinary Project, one Border Inspection Post will be upgraded initially. In addition, it is planned to improve the veterinary laboratories that support public health programs, and, with regard to animal welfare, to carry out the necessary administrative arrangements in accordance with the EU acquis by the end of 2005.

NOTE 1: The table on Financial Requirements is prepared according to the budget allocated to the Program on Combat against Animal Diseases and Harmful Organisms, the budget foreseen for the 2004-2005 period, and the financial resources provided through the EU Project. However, financial needs will exceed the above mentioned figures when the animal population, the current status of animal diseases, and the measures to strengthen the capacity and effectiveness of the institutions in charge of control mechanisms are taken into consideration.
NOTE 2: An extra 46 million Euro other than the amount specified in the table above is required for the proper implementation of the EU veterinary legislation and for the efforts of achieving disease control, particularly for the diseases in the list A of the OIE and for the eradication efforts in the long term in order to provide the free movement of live animals.
NOTE 3: Financing requirements for setting up a consultation committee and its secretariat on protection of animals used for experimental and other scientific purposes are shown under Priority 22.4 of the ‘Environment’ chapter.

PRIORITY 7.3 Alignment with the Phytosanitary Acquis and Establishment of the Necessary Institutional Capacity
1- Priority Description
In the 2003 Accession Partnership Document, adoption of a programme for the transposition of the phytosanitary acquis; strengthening the administrative, scientific and technical structures enabling the efficient and effective implementation of the acquis on plant protection, in particular laboratory testing, and strengthening inspection arrangements of both domestic production and imports of plants and plant products, are listed among the short term priorities. In addition, identification of the sites for the development and operation of a Community-compatible system of border inspection posts with third countries is determined as a short-term priority. For the medium-term, a plan and timetable for upgrading the system of border inspection posts is envisaged.
Phytosanitary matters are included as a priority in line with the priorities laid down in the Accession Partnership Document as well as with the recommendations of the European Commission listed in the 2002 Regular Report on the enhancement of the administrative capacity to enforce existing and new legislation to monitor and control diseases, establishment of new or refurbishment of existing plant health laboratories within the significant border inspection posts for agricultural products, and improvement of the laboratory capacity for residue monitoring and control of plant protection products. The significance of plant products in Turkish agriculture and exports also played a crucial role in identifying this topic as a priority.
A schedule of necessary legislative changes is provided for the adoption of the Community phytosanitary legislation in accordance with the short-term priority laid down in the Accession Partnership Document. Furthermore, in the short-term, identification of border inspection posts and alignment with Council Directives 89/117/EEC and 91/414/EEC, which are laid down in the Annex of ‘Decision No 2/97 of the EC-Turkey Association Council of 4 June 1997 establishing the list of Community instruments related to the removal of technical barriers to trade and the conditions and arrangements governing their implementation by Turkey’, is envisaged.
With regard to the schedule of necessary legislative changes, priority is given to the alignment with Council Directive 2000/29 EC, in order to establish the legal basis for alignment with other relevant Community legislation.
Efforts towards the enhancement of the institutional capacity for the implementation of legislation, which was and will be harmonised, will be carried out in the short-term and medium-term. In this regard, priority will be given to the establishment of the Directorate General of Agricultural Combat and Agricultural Quarantine under the Ministry of Agriculture and Rural Affairs.

PRIORITY 7.4 Preparation of a National Rural Development and Forestry Strategy
1- Priority Description
Since the 2001 National Programme, EU legislation on Rural Development Policy has been examined and a report on the current situation of rural development in Turkey has been prepared. A report entitled ‘Rural Development in Turkey on the Way to EU Membership’ is an important reference source which can be useful during the preparation of a Rural Development Strategy and Programme, which is laid down as a short term priority in the Accession Partnership Document.
Full alignment with the EU rural development legislation can be achieved upon membership. In the short-term however, it is envisaged to establish the instruments and institutional structure and capacity required for the implementation of the measures to be enforced after membership. For this purpose, in parallel with the EU rural development legislation, administrative structures such as a funding agency and regional committees will be established.
Moreover, for the effective and efficient functioning and implementation of the system, it is necessary that Turkey benefits from the Special Accession Programme for Agriculture and Rural Development (SAPARD), from which the candidate countries of the Central and Eastern Europe have benefited during the pre-accession period, or a similar program. Taking into consideration the possibility that Turkey will be included in SAPARD in the near future, it is envisaged to initiate the work on establishing the mechanisms required for the implementation of this programme.
In this regard, parallel to the 2003 Accession Partnership Document, preparation of a strategy for the introduction of the EC rural development policy and forestry strategy is identified as a short-term priority, while for the medium term, the objective is to set up the administrative structures required for the implementation of EC rural development policy and forestry strategy.

PRIORITY 7.5 Food Safety and Control
1-Priority Description
With the aim of ensuring the food safety of agricultural products from farm to table and the efficient implementation of control services, the Ministry of Agriculture and Rural Affairs and the Ministry of Health will carry out the harmonisation efforts and ensure the effective implementation of the legislation, within the scope of the duties granted to them by Decree Law No: 560.
As stated in the 2003 Accession Partnership Document, it is envisaged in the medium term to re-organise and strengthen the food safety and control system and upgrade its human, technical and financial resources to ensure that EC food safety standards are complied with. For the medium term, it is also planned to establish an up-grading plan with timetables to modernise food-processing establishments to meet EC hygiene and public health standards, and further establishment of testing and diagnostic facilities.
Providing food safety in agricultural products is crucial not only for the protection of consumers and public health but also for the alignment with the EU Common Agricultural Policy. In this regard, it is planned to complete the legislative harmonisation in the short term.
The modernisation of food-processing establishments, which is listed as a medium-term priority in the 2003 Accession Partnership Document, requires a significant amount of financial assistance. This modernisation could be realised earlier by including Turkey in SAPARD, from which the candidate countries of the Central and Eastern Europe have benefited during the pre-accession period, or a similar program.
In order to plan the modernisation of food-processing establishments, it is necessary that the financial requirements be identified. It is planned to identify these financial requirements through technical assistance.
Harmonization work on the reorganisation of food safety and control systems is discussed under Priority 1.3 (Foodstuffs) in the ‘Free Movement of Goods’ chapter.

4- Financing Requirements and Sources of Financing

PRIORITY 7.6 Adoption of the Legal Basis, Administrative Structures and Implementation Mechanisms for the Establishment of Common Market Organisations and Effective Monitoring of Agricultural Markets
1- Priority Description
In the Accession Partnership (AP) Document, the “adoption of the legal basis, administrative structures and implementation mechanisms for the establishment of common market organisations and effective monitoring of agricultural markets” is listed among the medium term priorities.
In accordance with this Priority, in the short term it is planned to examine the main EU legislation and primarily Council and Commission Regulations regarding common market organisations developed for all product groups, as well as the legislation related to those products which are not subject to common market organisation, but that are governed by a certain production model and for which an aid mechanism has been set up (such as cotton).
Following the above-mentioned examination, adoption of the Framework Law on Common Market Organisations in order to form the legal basis regarding all aid and support mechanisms developed for agricultural products and producers within the scope of the Common Agricultural Policy, as well as the establishment of the administrative structures in this context, is scheduled for the medium term.
It is envisaged that the Framework Law will contain only the essential provisions while details concerning implementation will be specified by Decisions of the Council of Ministers and implementing regulations. In this regard, as a starting point, the main Council and Commission Regulations on products which are subject to common market organisation are included in the Schedule of Necessary Legislative Changes. Regulations on implementation details such as arrangements related to export refunds, storage aids, and intervention purchases are not dealt with at his stage. However, as the legal basis necessary for alignment with the said legislation will be established in the Framework Law, it is planned that harmonisation with this legislation will be carried out after 2006 through Decisions of Council of Ministers and implementing regulations.
Moreover, it is foreseen in the Schedule of Necessary Legislative Changes that alignment with the EU legislation on quality and standards, and with those for which a certain institutional capacity has to be established before accession, will take place in the medium term.
In this context, arrangements regarding the product groups that are important for Turkey and for which there is a substantial need for institution building and infrastructure, are covered within the scope of this Priority.
On the other hand, sheep and goat meat, which has a significant share in Turkey’s agricultural production and consumption, is not dealt with under a separate heading. The registration system that is envisaged to be used in the direct aids given in accordance with the relevant Council Regulation, is stated under Task 7.1.1 Setting up the Main Components of the Integrated Administration and Control System (IACS), under Priority 7.1 Alignment in Horizontal Issues, and it is aimed to build the infrastructure necessary for harmonisation with the common organisation of the market in sheep and goat meat.
Efforts continue for the enactment of the Law on Agricultural Producer Unions, which will cover all the producers in Turkey, in order to make it possible for them to be organised. The goal pursuant to the Framework Law is to establish a structure similar to that of the EU for certain product groups, through Decisions of the Council of Ministers and implementing regulations.
Technical assistance received from the EU in the field of common market organisations has been rather limited. Therefore, a final decision could not be made on issues related to institution building with regard to common market organisations, such as the number of intervention agencies, and the structure of market controls. As a result, institution building and financing requirements stated under this Priority indicate the needs determined by Turkey at this stage, while other requirements will be identified in a more detailed manner following the receipt of technical assistance.

II- MEASURES FOR HARMONISATION WITH THE EU LEGISLATION AND IMPLEMENTATION

PRIORITY 8.1 Establishment of the Legal Framework for Alignment with the Common Fisheries Policy
1-Priority Description
The lack of the administrative structure and legislation essential for the functioning of basic management mechanisms, in particular for the Financial Instrument for Fisheries Guidance (FIFG) and the Multi Annual Guidance Programme (MAGP), appear to be the main problems in the context of Turkey’s alignment process with the EU Common Fisheries Policy.
In this context, parallel to the 2003 Accession Partnership Document, alignment of Turkish legislation on fisheries management, control, marketing and structural adjustment with the Community acquis is identified as a short-term priority. For the medium term, the objective is the re-organisation and strengthening of the institutional capacity of the fisheries administration; alignment of fisheries management, control and marketing and structural alignment in accordance with the EU acquis; development and implementation of a computerised fisheries vessel registration and statistical information system in compliance with the acquis.
In order to achieve these objectives, a project with the title of ‘Fisheries Sector-Legal and Institutional Alignment with the EU Acquis Project’ is proposed within the framework of the 2003 Pre-accession Financial Assistance Programme. The project will be successful only through the establishment of a Directorate General for Fisheries within the Ministry of Agriculture and Rural Affairs, or a similar autonomous body, and through the harmonisation of the legislation within the scope of the project in accordance with a timetable.
