Law No.1211 on the Central Bank of the Republic of Turkey is amended through Law No.4651, which entered into force upon its publication in the Official Gazette No. 24393 on 5 May 2001.

II- MEASURES FOR HARMONISATION WITH THE EU LEGISLATION AND IMPLEMENTATION
PRIORITY 11.1 Strengthening the independence of the Central Bank of the Republic of Turkey
1- Priority Description
In accordance with the provision set forth in the Treaty Establishing the European Community and the Statute of the European System of Central Banks, which requires that the primary objective of central banks shall be to maintain price stability, it is stipulated through Law No.4651 that the primary objective of the Central Bank of the Republic of Turkey is to maintain price stability.
Determination of the price stability as the main objective requires central banks to have institutional, personal, and operational and financial independence. Accordingly, amendments to Law No.1211 are established through Law No.4651, which aims to strengthen the existing structure of the Bank with respect to institutional, personal, and operational and financial independence.
The criterion of independence has been achieved to a great extent with the amendment of Law No.1211 on the Central Bank of Republic of Turkey through Law No. 4651. However, regarding the recent comments in the Regular Report, compliance and harmonisation shall be achieved just before accession to the EU.

PRIORITY 11.2 Harmonisation of the legislation with the provisions of the acquis regarding the prohibition of privileged access of public sector authorities to financial institutions 1)
1- Priority Description
Article 15 of the Insurance Supervisory Law lists the reserves that can be accepted as collateral. The following assets may be accepted as collateral:
- Cash deposits in Turkish Lira and foreign exchange dealt by the Central Bank of the Republic of Turkey,*
- The State's domestic and foreign bonds, Treasury promissory notes, profit sharing certificates or other stocks and bonds to be issued by the State,*
- Shares of companies in which more than 51 % of the capital is owned by the State,*
- Other capital market instruments acceptable by the Undersecretariat, *
- Real estate owned by insurance companies in Turkey.
“Other capital market instruments acceptable by the Undersecretariat” makes it possible for insurance companies to hold shares of foreign companies and foreign bonds, and other foreign treasury bills and bonds. This article regulates in general terms those assets that can be accepted by the Undersecretariat of Treasury as collateral. It does not impose any restrictions on insurance undertakings or prevent them acquiring those assets as collateral. In practice, insurance and reinsurance companies do invest in such financial instruments and they are perfectly acceptable by the Undersecretariat of Treasury. In this context, in the insurance legislation there is no provision providing privileged access of public sector authorities to financial institutions.

PRIORITY 11.3 Harmonisation of the legislation with the provisions of the acquis regarding the prohibition of direct financing of the public sector
1- Priority Description
Prohibition of granting advances to the treasury and extending credit to public establishments and institutions by central banks is set forth in the Treaty Establishing the European Community and the Statute of the European System of Central Banks.
Accordingly, Article 56 of Law No.1211, under the heading of “Operations prohibited for the Bank” was amended by Law No.4651 as to read “The Bank shall not grant advance and extend credit to the Treasury and to public establishments and institutions and shall not purchase debt instruments issued by the Treasury and public establishments and institutions in the primary market.”
In addition, Articles 50 and 51 of the said Law, pertaining to short-term advances to the Treasury and credit to public institutions respectively, were repealed.
The criterion of independence has been achieved to a great extent with the amendment of Law No.1211 on the Central Bank of Republic of Turkey through Law No. 4651. However, regarding the recent comments, compliance and harmonisation shall be achieved just before accession to the EU.

PRIORITY 11.4 Full harmonisation of government finance statistics with the requirements of the European System of National and Regional Accounts in the Community (ESA95)
1- Priority Description
The Ministry of Finance is working on the Public Financial Management and Government Accounting Reform Programme. In this context, the Public Financial Management and Control Draft Law and a Government Accounting General Draft Regulation, covering internationally accepted accounting and reporting standards for the whole of the general government sector, have been prepared. After finalisation of these regulations the Ministry of Finance will be the single unit responsible for compiling and disseminating public finance statistics.
In addition to internationally accepted accounting and reporting standards, the accounting reforms also include a framework chart of accounts and budget classification based on the International Monetary Fund (IMF) Government Financial Statistics Manual (GFSM 2001) for all governmental units defined in the general government sector. The new modified accrual based accounting system and budget classification will be used in the consolidated budgetary agencies in 2004, and in all general government agencies in 2005. Then, all general public finance statistics will be consolidated and made public by the Ministry of Finance, according to international standards. Subsequently, it is planned to complete the work on physical assets in the consolidated budgetary agencies and to move to full accrual based accounting and reporting in 2007. After completing all this work, general government statistics will be made public on a quarterly basis.

PRIORITY 11.5 Preparation of the central bank for functioning within the framework of the European System of Central Banks
1- Priority Description
In accordance with Article 107 of the Treaty Establishing the European Community and Article 1 of the Protocol on the Statute of the European System of Central Banks and of the European Central Bank, the European System of Central Banks is composed of the European Central Bank and of the central banks of the Member States. On becoming a full member of the EU the Central Bank of the Republic of Turkey will be a part of the System, and necessary harmonization will be achieved at that stage.

Regarding regional statistics, the Council of Ministers Decision of 2002/4720 concerning the Definition of Classification of Regional Units for Statistics in Turkey, which will enable the collection of relevant data compatible with the Union’s NUTS criteria, was published in the Official Gazette on 22 September 2002, nNo.: 24884 on 22 September 2002.
lLaw no: 4651 of 25 April 2001 amending the Central Bank of the Republic of Turkey’s (CBRT) Law No 1211, corresponding to the Guideline of the European Central Bank of 11 May 2000 on the statistical reporting requirements of the European Central Bank in the field of balance-of-payments statistics, the international reserves template and international investment position statistics, was published in the Official Gazette on 5 May 2001, No.: 24393 on 5 May 2001, and has entered into force on the same day. This amendment authorizes the Central Bank of the Republic of Turkey to request and collect all statistical information relating to balance of payments statistics directly from banks, other financial institutions and persons.
lLaw nNo.: 4651 amending the lLaw of the Central Bank of the Republic of Turkey (CBRT) has also maintained harmonisation with the Council Regulation No 2533/98/EC of 23 November 1998 concerning the collection of statistical information by the European Central Bank . With this amendment, authority was given to the CBRT to collect statistical information not only from banks but also from other financial institutions in order to monitor the financial markets.
The same amendment in the lLaw has also maintained harmonisation with Regulation No 2819/98/EC of the European Central Bank of 1 December 1998 concerning consolidated balance sheets of the monetary and financial institutions sector.
Law No. 4904 on Turkish Employment Organization, corresponding to Commission Regulation No 1924/1999/EC, Commission Regulation No 1897/2000/EC, Council Regulation No 577/98/EC and Commission Regulation No 1925/1999/EC regarding labour force statistics, was published in the Official Gazette on 22 September 2002, nNo.: 25159 on 5 July 2003.

II- MEASURES FOR HARMONISATION WITH THE EU LEGISLATION AND IMPLEMENTATION

PRIORITY 12.1 Data Security Aand Statistical Confidentiality

1- Priority Description
In the framework of the Turkish National Programme for the Adoption of the Acquis of 24 March 2001, a new Statistical Law must be prepared with respect to work to be completed in the statistical area and the draft law model proposed by Eurostat. For this purpose, a Legislation Preparation Sub-Committee was formed for the works foreseen in the first national programme. The Draft Statistical Law prepared by this Committee was presented to the Presidency of the Institute. Following high-level meetings in the Presidency, the draft law has been completed. After preparation of justifications and translation into English, it will be presented to other public institutions for their opinions.

Turkey has to comply with the EU legislation regarding implementation and usage of classification, standards, and terminology.
The correct and efficient usage of international, European and national classifications in the data collection and compilation process at the State Institute of Statistics (SIS) as well as at the other public administrations and private institutions should be improved.

a) Turkey is largely in conformity (i.e. codes and definitions of goods, duty rates of goods covered by the customs union, measurement units, chapter and section notes and annex notes) with the Combined Nomenclature provided in Annex 1 of Council Regulation 2658/87. The first alignment was implemented with the Decision of the Council of Ministers No 95/7591 amending the Customs Tariff List. In accordance with the revisions in the Combined Nomenclature of the EU, Turkish Customs Tariff Lists are published as a Decision of the Council of Ministers every December (The latest Decision of the Council of Ministers was published in the Official Gazette No 24078 of 29 December 2002). Partial harmonization has been made with the trade measures listed in Annex 2 of the above mentioned Regulation. PRIORITY 12.3 Registers
1- Priority Description
Modelling and applying a new Business Registers System
The concepts and definitions of European Union regulations related to setting up a new Business Registers system should be adopted. Based on this study, the new system should be modelled and implemented.
Applying address standards for administrative sources
Administrative sources to be used for establishing and updating procedures of Business Registers are required to use the standard address structure. The purpose of this study is to compare data from the same region originating from different sources.
Data sharing
Related Public institutions (Ministry of Finance, Social Insurance Institution (SSK), Turkish Employment Organization (ISKUR), Labour Institution, The Union of Chambers of Commerce and Commodity Exchanges of Turkey etc.) providing data to SIS within the scope of Business Registers, should introduce some changes in their laws in order to share those data with SIS. Alignment with the Legislation on Structural Business Statistics (Statistical Coordination)
In order to produce business statistics in line with EU standards, it is planned to compile and disseminate the data by implementing technical variables, classifications, statistical units, and quality criteria defined by and described in related EU legislation. Field applications to obtain a business register in line with statistical units, classifications and criteria defined in the structural business statistics legislation has been initiated with the 2002 General Census of Industry and Business Establishments. Accordingly, variables stated in the EU legislation have been added to sectoral surveys for 2001.

Variables defined in the related EU legislation have been added to current 2001 short-term surveys (in manufacturing, mining and quarrying, electricity, gas and water sectors).

PRIORITY 12.5 Population and Demographic Statistics
1- Priority Description
Population and demographic statistics are being gathered according to Law No. 3152 on the oOrganization and dDuties of the Ministery of Interior, and Law No. 1587 on Population, and are sent to Eurostat according to Council Regulation No. 1588/90 of 11 June 1990 on the transmission of data subject to statistical confidentiality to the Statistical Office of the European Communities. Moreover, strengthening the statistical module of the database of the Central Demographical Administration System (MERNIS) launched as of January 2003 will facilitate up-to-date monitoring of population and demographic events and effective compilation of the data. For this purpose a protocol was signed between the State Institute Statistics (SIS) and The General Directorate of Population and Citizenship Affairs of the Ministry of Interior on 16 August 2002. The General Directorate of Population and Citizenship Affairs, SIS, and Institute for Population (Demographic) Studies of Hacettepe University are the institutions responsible for performing the duties stipulated in the aforementioned protocol.

PRIORITY 12.6 Statistics Related To the Labour Force, Wages, Labour Costs And Structure of Earnings

Task 12.6.1 Labour Force Statistics
1- Priority Description
Full compliance with EU legislation on variables used in the survey
Including newly requested variables into the Labour Force Survey (LFS) questionnaire by following the new Eurostat regulations and ensuring full compliance with the respective EU legislation. Thus, the results of the labour force survey produced fully in harmony with EU standards can contribute more comprehensively to the statistics collected and published by the EU.
Increasing the sample size of the survey and re-designing the sample design to give estimates according to NUTS 2 level
Producing labour force statistics on the basis of regional classification, combining socially and economically homogenous provinces, will lead to the production of the regional labour force statistics required by the EU. From the national perspective, regional labour force statistics will be a very important data source for regional development and employment strategies.
Conducting the modular surveys requested by Eurostat on the different aspects of the labour market from the beginning of the year 2005
Eurostat requests modular surveys to be carried out together with the LFS in order to gather detailed data on different aspects of the labour market. Even though the surveys on the topics Eurostat has requested have not yet been conducted, in order to provide data needed in various areas of the labour market modular surveys such as Child Labour, and Education and Training have been carried out together with the LFS. From 2005 onwards, it is planned to conduct modular surveys requested by Eurostat together with the LFS. Detailed data on different aspects of the labour market collected through these modular surveys will be a very important data source for decision makers, researchers and technicians on a national basis. Moreover, this data will also facilitate international comparisons.
Preparing the quality control report regularly in order to increase data quality of the surveys.
In order to increase the data quality of surveys, quality control reports are planned on the following topics: Accuracy (sampling and non-sampling errors), timeliness, accessibility, comparability, coherence and completeness. Through the quality control reports, errors deriving from the field application of the survey will be eliminated (or minimized), the LFS will reflect the economic developments in our country in a better way and the data quality will be increased to the desired level.

Task 12.6.2 Statistics Oon Wages, Labour Cost And Structure of Earnings
1- Priority Description
Regular implementation of the Labour Cost Survey (LCS)
The SIS has been compiling data on labour costs through annual Manufacturing Surveys since 1993. However, this data is not compatible with the labour cost data set requested by Eurostat in terms of coverage and detail . Therefore, the Institute aims to conduct regular independent Labour Cost Surveys to Eurostat standards. The first independent Labour Cost Survey will be applied as a pilot study in the framework of Eurostat project in 2003.
In European Union countries the Labour Cost Survey is conducted regularly once in every four years, beginning with the 2000 reference year, in accordance with the regulations. Therefore, to be in line with related regulations in terms of timeliness, the survey will be repeated in 2005, using the reference year 2004, and covering all sectors, following the establishment of a fresh frame by using the results of the 2003 General Census of Establishments. The Institute aims to conduct the survey regularly at four year intervals from the beginning of 2004.
In preparation, a draft questionnaire on the Labour Cost Survey, which is to Eurostat standards, was designed and tested twice in Ankara in 2002.
Regular implementation of the Structure of Earnings Survey (SES)
The State Institute of Statistics conducted an Employment and Wage Structure Survey with the reference year 1994, which is equivalent to the Eurostat Structure of Earnings Survey of 1995. However, to date the survey could not be repeated due to frame problems. The Institute aims to conduct a Structure of Earnings Survey regularly in line with EU standards. A pilot survey on this issue is going to be carried out in the year 2004 within the framework of the EU compliance project.
The Structure of Earnings Survey has been carried out regularly once every four years in EU Member States since the year 2002, according to the related regulations. Therefore, compliance regarding timing will be possible with the implementation covering all sectors which will be introduced in 2007, taking 2006 as the reference year. It is planned to conduct the survey once every four years from the beginning of 2006.

Task 12.7.2 Alignment with the Legislation on Health and Safety at Work
1- Priority Description
Turkey has to adapt its legislation to that of the EU on health and safety at work, and implement it properly. The most important indicator of a countries’ health and safety at work level is the statistical data regarding occupational accidents and occupational diseases in that country. The alignment with EU legislation in the field of health and safety at work is carried out by the Ministry of Labour and Social Security. The effective harmonisation with the acquis in this field can only be assessed by the rapid, accurate, and sustained monitoring of statistical data regarding health and safety at work.

PRIORITY 12.8 Annual Economic Accounts, Quarterly and Environmental Accounts, Monitoring and Resources
1-Priority Description
Annual Economic Accounts (TransferingTransferring to ESA 95)
The current National Accounts System in Turkey is based on SNA 68. In order to ensure alignment with the ESA 95, working groups have been established and a working plan has been preperedprepared in cooperation with Eurostat experts in order to determine the priorities and the content of the alignment with this new national accounts system. It is envisaged to finalise the work regarding the compilation of basic and detailed tables of the annual economic accounts and revision of the methodology of national accounts.
Quarterly and Environmental Accounts
It is envisaged to establish the quarterly and environmental accounts within the context of the working plan which was prepared in cooperation with Eurostat experts in the framework of aligning with ESA 95.
Monitoring and Resources
The alignment of the acquis regarding the calculation of Gross National Product (GNP) is ongoing. For this reason, sub- working groups have been established in order to align with ESA 95. A working plan has been prepared with the experts of Eurostat.

PRIORITY 12.9 Financial Accounts
1- Priority Description
Revision of the national accounts methodology for the implementation of ESA 95.
A study, coordinated by the Central Bank of the Republic of Turkey in cooperation with the Ministry of Finance, the Undersecretariat of the Treasury, and the State Institute of Statistics has started to compile financial accounts. It aims to determine the existing situation, define standards and data requirements as a priority.
In addition, the Ministry of Finance has prepared a Draft Implementing Regulation on Accrual Based Government Accounts Regulation in order to have all registries comply with ESA 95 principles and standards and Accrual Based Accounts System and to ensure that the accounting system creates data in compliance with these bases. The new modified accrual based accounting system and budget classification will be used in the consolidated budgetary agencies in 2004 and in 2005 in the other general state units. After completion of these studies, all financial account statistics for general state units will be consolidated by the Ministry of Finance in compliancely with international standards.

PRIORITY 12.10 Prices
1- Priority Description
Necessary studies to be undertaken by SIS in the framework of this priority is clarified are as follows:
Determining newly significant goods & services and including them into the weighting structure
Annual Household Budget Surveys will be used for the identification of newly significant goods and services. From these surveys, goods and services which have a weighting of more than 1/1000 of the total expenditure will be identified. Weights will be examined every year and, if needed, they will be updated. The resulted index will be linked to the old index series.
Extension of coverage
Some of the sub-groups are not covered in the current Harmonised Index for Consumer Prices (HICP). These sub-groups will be included in the coverage of the HICP according to their consumption expenditure values.
Fire and car insurance, second hand cars and package tours
Data concerning fire, car insurance, second hand cars and package tours will be compiled by the Household Budget Survey.
Improvement of methods for quality adjustment
In addition to the existing method, studies have begun on comparing methods applied by EUROSTAT and international institutions.
Determination of the total consumption expenditure of the institutional population
Studies to improve the methods and the analysis of results of the Household Budget Survey that determine the expenditure of the institutional population in Turkey, persistsTurkey, still continue.
Determination of the total consumption of foreign tourists in Turkey
Studies to improve the methods and analysis of results of a small-sized survey on the expenditure of foreign tourists in Turkey persistsTurkey continue.

National regulations for national and international goods and passenger transportation by road will be amended according to EU legislation in order to improve the standards in this field to the level atlevel of the EU Member States.
Following the enactment of the Draft Law on Road Transportation, necessary amendments will be made on the Implementing Regulation on international transport of goods and passengers by road and the Implementing Regulation on intercity transport of passengers by road according to the EU legislation. In addition, the new Implementing rRegulation on intercity transport of goods by road will be prepared to comply with the EU legislation.
The Ministry of Transport, General Directorate of Road Transport will make the related arrangements concerning statistics according to Turkish Statistical Law. Within this scope, statistical information obtained from transportation enterprisesagencies will be registered, evaluated and tabulated by the Ministry of Transport and will be transmitted to the SIS.

Task 12.12.2 Road Accidents
1- Priority Description
In Turkey there is no legislation related to compilation of road traffic accident statistics. The statistics on accidents are prepared on the basis of the Accident Statement Form in accordance with Law No 2918 of 1985 on Road Traffic. However, these statistics do not cover data related to people who die 30 days after the related accident. Therefore it is foreseen that alignment with the EU legislation be ensured with the respective amendments to the related law.

1- Priority Description
Statistics on sea transport and trade fleets are kept by the Undersecretariat of Maritime Affairs, Directorate General for Sea Trade, founded by Decree a decree having the force of law NoLaw No. 4745 of 7 February 2002 on the establishment and duties of the Undersecretariat of Maritime Affairs, Law on Public Officers, Allowance Law and Law Amending the Decree Lawabout making change on decree having the force of law on gGeneral sStaff and pProcedure. In order to collect these statistics, an on-line system was established between regional directorates and headquarter by the Undersecretariat’s project for Supply, Installation and Modernizsation of Information Management Systems. However, because of some technical problems, the flow of data cannot be provided. Studies on providing full functionality of the system are ongoing. With the effective implementation of the project, statistics on the carriage of goods and passengers by sea will be received and disseminated electronically according to norms and standards in conformity with the EU Legislation.

Regarding regional statistics, the Council of Ministers Decision of 2002/4720 concerning the Definition of Classification of Regional Units for Statistics in Turkey, which will enable the collection of relevant data compatible with the Union’s NUTS criteria, was published in the Official Gazette on 22 September 2002, nNo.: 24884 on 22 September 2002.
Based on a territorial breakdown that meets the NUTS criteria, methodological concepts in compliance with EU methodological requirements related to regional data collection will be developed and applied. The establishment of a comparable and a reliable data set is needed at the regional level in order to meet EU information demands.

1- Priority Description
The State Institute of Statistics does not have corresponding legislation, since these committees are established under rationales and arrangements specific to the structure of the EU. These committees were created for ensuring efficient coordination between the Member States. In this respect necessary secondary legislation will be introduced in the Turkish Statistical Law following Turkey’s membership. PRIORITY 12.19 Balance of Payments
1- Priority Description
Publishing balance of payments statistics in the standard form according to EurostatUROSTAT requirements
With Law No 4651 of 25 April 2001 amending Law No 1211 of the Central Bank of the Republic of Turkey (CBRT), authority was given to the CBRT to collect statistical information not only from banks but also from other financial institutions and persons in order to monitor balance of payments developments. The CBRT is also empowered with the authority to publish and send to Eurostat Turkey’s balance of payments statistics in the standard form according to Eurostat requirements. In this context, starting from the Accession Partnership dated March 8 2001, the work implemented in order to publish Turkey’s balance of payments statistics in the standard form according to EurostatUROSTAT requirements is listed below:
- The data set related to quarterly balance of payments questionnaires ( Questionnaire Q1) are transmitted quarterly for 2000, 2001 and 2002 in GESMES/CB format,
- FDI - Direct investment flows broken down by economic activity and by geographical area, abroad and in the reporting economy data- annual ( Questionnaires Y5-1, Y5-2, Y6-1, Y6-2 )were reported as an Excel file for 1999, and for the years of 2000 and 2001 in December, 2002 in GESMES/CB message format,
- FDI - Direct investment positions broken down by economic activity and by geographical area, in the reporting economy data – annual ( Questionnaires Y7-2, Y8-2) transmitted in December, 2002 in GESMES/CB format,
- Balance of payments questionnaires - annual (Questionnaire Y1 ) data were transmitted in the quarterly format ( Questionnaire Q1 )for 1999, 2000 and 2001 in GESMES/CB format.

1- Priority Description
In the context of alignment with Council Regulation (EC) No 2533/98 of 23 November 1998 concerning the collection of statistical information by the European Central Bank (ECB), authority to collect statistical information not only from banks but also from other financial institutions in order to monitor financial markets was given to the CBRT by Law No 4651 of 25 April 2001 amending Law No 1211 of Central Bank of the Republic of Turkey (CBRT). In this framework, hormanizationharmonisation studies on the compilation of banking sector statistics in line with ESA 95 sector classifications and definitions, and ensuring the reporting of these statistics to the ECB are ongoing.

Task 12.20.2 Reporting of Consolidated Balance Sheets of Monetary Financial Institutions (MFI)
1- Priority Description
In the context of Regulation (EC) No 2819/98 of the European Central Bank of 1 December 1998 concerning consolidated balance sheets of the monetary financial institutions sector (ECB/1998/16, periodic preparation and reporting of consolidated balance sheets of the MFI sector to EU standards to the ECB by the CBRT has been ensured by Law No. 4651 of 25 April 2001 amending Law No. 1211 of the Central Bank of the Republic of Turkey (CBRT) and CBRT’s Directive 1) of 5 February 2003.
Studies to reflect the new arrangements of the Banking Regulation and Supervision Agency (BRSA) in existing money and banking statistics, and also to enlarge the MFI definition for Turkey are being carried out.

Task 12.20.3 Compilation of Financial Accounts in compliancey with ESA 95
1- Priority Description
In the context of alignment with Council Regulation (EC) No 2223/96 of 25 June 1996 concerning European national and regional accounts of the Community, a joint study coordinated by the CBRT in cooperation with the Ministry of Finance, the Undersecretariat of Treasury, and the State Institute of Statistics has been initiated in order to compile financial accounts in line with the ESA 95 and Eurostat reporting. The study aims to determine the existing situation, define the data standards and additional data requirements for the Monetary Financial Institutions and Other Financial Corporations (insurance companies, leasing companies etc.) sector.
In addition, the Ministry of Finance has prepared the Draft Implementing Regulation on Accrual Based Government Accounts Regulation in order to have all registries comply with ESA 95 principles and standards and the Accrual Based Accounts System, and to ensure that the accounting system creates data in compliance with these bases. The new modified accrual based accounting system and budget classification will be used in the consolidated budgetary agencies in 2004, and in 2005 in the other general state units. After completion of these studies, all the financial account statistics for general state units will be consolidated by the Ministry of Finance in compliancely with international standards.
